  1. StelSOFT Innovations Stellar Game Development Kit (tm) 98
  2. SHAREWARE VERSION

  4. END USER LICENSE AGREEMENT
  5.  
  6. This is a legal agreement between you, the end-user, and StelSOFT
  7. Innovations ("Agreement"), for the use of the Stellar Game 
  8. Development Kit ("SOFTWARE PRODUCT").
  9.  
  10. 1. Grant of license. StelSOFT Innovations hereby grants you a non-
  11.    exclusive license to test the SOFTWARE PRODUCT to develop your 
  12.    application product ("Application") for a period not exceeding 
  13.    thirty (30) days in length.
  14.  
  15. 2. Distribution. You are permitted to distribute the SHAREWARE 
  16.    version of the SOFTWARE PRODUCT, where applicable, assuming it 
  17.    is distributed in its original, unmodified form. No individual 
  18.    components of the SOFTWARE PRODUCT may be distributed 
  19.    seperately from the original SOFTWARE PRODUCT release. You are 
  20.    not permitted to distribute your Application under any 
  21.    circumstances, without prior written consent of the President
  22.    of StelSOFT Innovations. Mass distribution of the SOFTWARE 
  23.    PRODUCT on media is not permitted without prior consent of the 
  24.    President of StelSOFT Innovations. For the purpose of this 
  25.    clause, "Mass distribution" implies distribution of five (5) 
  26.    or more copies.

  28. 3. Warranty. StelSOFT Innovations provides no warranty for this 
  29.    product whatsoever. THE SOFTWARE PRODUCT IS LICENSED "AS-
  30.    IS," AND STELSOFT INNOVATIONS DISCLAIMS ANY AND ALL OTHER
  31.    WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING
  32.    (WITHOUT LIMITATION) ANY IMPLIED WARRANTIES OF
  33.    MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE,
  34.    AND ANY WARRANTY THAT THE SOFTWARE PRODUCT WILL
  35.    FUNCTION IN CONJUNCTION WITH OR ON ANY COMPUTER
  36.    HARDWARE OR  SOFTWARE NOT EXPRESSLY SUPPORTED BY
  37.    THE SOFTWARE PRODUCT AT THE TIME THIS AGREEMENT 
  38.    FIRST BECOMES EFFECTIVE.

  40. 4. Limitation of Liability. You agree to indemnify, hold harmless 
  41.    and defend StelSOFT Innovations, Microsoft, and its suppliers, 
  42.    from and against any claims or lawsuits, including attorney's 
  43.    fees, that arise or result from the use or distribution of the 
  44.    SOFTWARE PRODUCT or your Application.  StelSOFT Innovations 
  45.    cumulative liability to you or any other party for any loss or 
  46.    damages resulting from any claims, demands, or actions arising
  47.    out of or relating to this Agreement shall not exceed the license 
  48.    fee paid to StelSOFT Innovations for the use of this product.

  50. 5. Copyright. All rights, title and copyrights in and to the
  51.    SOFTWARE PRODUCT (including but not limited to any images,
  52.    photographs, animations, video, audio, music, and text
  53.    incorporated into the SOFTWARE PRODUCT), and any copies of
  54.    the SOFTWARE PRODUCT, unless otherwise specifically specified,
  55.    are owned by StelSOFT Innovations. The SOFTWARE PRODUCT is
  56.    protected by copyright laws and international copyright treaties.
  57.    Therefore, you must treat the SOFTWARE PRODUCT like any other
  58.    copyrighted material. You may not copy any printed materials
  59.    which may accompany the SOFTWARE PRODUCT. No Application
  60.    (as described in Section 1) may be created to serve similar
  61.    purposes as those served by the SOFTWARE PRODUCT.

  63. 6. Prohibited Uses. UNDER NO CIRCUMSTANCES SHALL YOU ENGAGE
  64.    IN, OR KNOWINGLY PERMIT OTHERS TO ENGAGE IN, ANY OF THE
  65.    FOLLOWING WITH RESPECT TO THE SOFTWARE PRODUCT AND
  66.    RELATED MATERIALS:

  68.         a] Renting, Selling or Leasing the SOFTWARE PRODUCT or
  69.            RELATED MATERIALS
  70.  
  71.         b] Commercially exploit the SOFTWARE PRODUCT through
  72.            any medium or for any commercial purpose.

  74.         c] Copy any component of the SOFTWARE PRODUCT or your
  75.            Application as described in Section 1, except as
  76.            permitted above.

  78.         d] Distribution of Applications developed with the
  79.            shareware version of the SOFTWARE PRODUCT.

  81. 7.  Entire Agreement. This Agreement constitutes the entire Agreement
  82.     between the parties. This Agreement may not be amended or modified 
  83.     except in a writing signed by you and StelSOFT Innovations.
